Terms & Conditions of Transport and GTC

a) Terms and Conditions of Transport

Public Transport

The conveyance of passengers is subject to the general Terms and Conditions of Transport of the shipping company. Force majeure, high or low tide, machinery breakage, lock problems, suspension of traffic on the Weser, insufficient number of passengers (minimum 20 people) and adverse weather conditions release the shipping company from the observance of any or all schedules.
Times given are approximate. No claims can be made for punctuality in forwarding of passengers. Reserved seats must be taken latest 10 minutes before departure after which time reservations are no longer valid. In the event of a journey not taking place for reasons beyond control of the shipping company only moneys already paid for that journey will be reimbursed. Any further demands are excluded.

b) General Terms and Conditions

These terms and conditions apply to the management of events on our passenger ships and to all appendent deliveries and services carried out by Hal över, Gesellschaft für innovative Stadttouristik mbH , hereafter named Hal över , for the ordering party, hereafter named Organiser.

1. All agreements written or verbal between Hal över and the Organiser concerning events which include catering choice, event planning and any further appendent services and deliveries are binding.

2. All prices include mandatory V.A.T. Any increase in mandatory V.A.T. occurring  after completion of contractual agreement is to be covered by the Organiser.

3. Upon completion of contractual agreement a down payment of 10% of the charter price is to be made by the Organiser to Hal över.
One third of the total invoice sum is payable by the Organiser to Hal över one week before event start.

4. All Hal över invoices are due without discount no later than 7 days after date of invoice.

5. Hal över calculates the buffet menu on the basis of a minimum of 20 guests. If there are less than 20 guests Hal över calculates an extra charge per participant correspondingly. The Organiser must confirm the final number of buffet guests latest 5 days before event start in order to assure proper preparation. In the case of a reduction in the number of confirmed buffet guests less than 72 hours before event start Hal över will charge the Organiser 50 % of the agreed gastronomic service price per person per absentee, and less than 24 hours before event start Hal över will charge the Organiser 100 % of the agreed gastronomic service price per person per absentee. If the confirmed number of guests is exceeded without Hal över being previously informed by the Organiser then Hal över takes no responsibility in regard to quantity of food and drink or adequacy of catering staff at the said event.

6. If an event cannot take place for reasons independent of Hal över then Hal över has the right to claim payment of fair compensation in an amount corresponding to the time of event cancellation and to any additional services scheduled, especially catering. Cancellations by the Organiser must be confirmed to Hal över in writing. Hal över charges a handling fee equal to 10% of the contractually agreed charter price for any cancellation made less than 3 months before event start, a handling fee equal to 30% of the contractually agreed charter price for any cancellation made less than 1 month before event start and a handling fee equal to 75% of the contractually agreed charter price for any cancellation made 10 days or less before event start. In the case of any cancellation made less than 5 days before event start Hal över charges a handling fee of 80% of the contractually agreed charter price.

7. If an all-inclusive event lasts longer than the agreed time span Hal’över will invoice any extra services  on a pro rata basis.

8. If the Organiser wishes to have more staff than Hal över would usually employ for an event the extra costs are to be met by the Organiser.

9. The Organiser is equally responsible for loss or damage caused by event helpers or participants as for any loss or damage caused by himself or herself. The Organiser must take out the insurance policies necessary to cover any such eventuality. Hal över has the right to demand proof of such insurance policies. Bringing decoration materials or other objects on board should first be discussed and agreed upon with Hal’ over in order to avoid damage to ships. The Organiser is responsible especially for the fact that any decoration materials used must comply to fire safety regulations, whereby in case of doubt Hal över can demand the presentation of a letter of confirmation from the fire control authorities. Hal över is responsible for loss or damage of brought objects only when at statutory fault under provision of law.

10. If Hal över orders technical or other equipment from third parties on behalf of the Organiser then Hal över acts in the name and on account of the Organiser. The Organiser is fully responsible for the careful handling and orderly return of such equipment and frees Hal över from any and all possible demands from third parties in regard to the assignment of such equipment.

11. It is strictly forbidden for the Organiser to supply food and drink for an event. In special cases if the Organiser so wishes it is possible to draw up a separate written agreement covering this eventuality wherein a service charge or corkage fee to be paid by the Organiser to Hal över will be calculated. The exact sum to be charged is to be mutually determined by Hal över and the Organiser and based on the loss in sales.

12. Any newspaper advertisements including invitations to job interviews and/or sales events or information about other events are strictly forbidden unless previously approved in writing by Hal över. If publication of advertisements takes place without previous written permission and substantial commercial interests of Hal över are affected by this then Hal över has the right to cancel the event in question: in such cases Paragraph 5 of General Terms and Conditions is applicable.

13. Hal över has the right to cancel an event if Hal över has reasonable cause to believe that the event threatens to endanger the smooth running of Hal över’s operations, or the safety or the reputation of the company, or in case of force majeure.

14. Place of contract fulfilment and jurisdiction is Bremen.

15. Should a clause of the General Terms and Conditions become invalid this does not affect in any way the validity of other clauses. The invalid clause is replaced by the most similar valid clause possible. The General Terms and Conditions are an integral part of any contractual agreement. The General Terms and Conditions are publicly posted and will be supplied by Hal över upon request.
